Welcome to iMegaSafe. By accessing or using www.megasafe.com, purchasing from our store, creating an account, contacting us or otherwise using the Services, you agree to these Terms of Service and the policies referenced in them.

These Terms do not limit mandatory consumer rights that cannot legally be waived in your country or region.

1.1 Eligibility and Use of the Services

You must be at least the age of majority in your jurisdiction or use the Services with the consent and supervision of a parent or legal guardian.

You agree to use the Services only for lawful purposes and in accordance with these Terms.

1.2 Our Products

iMegaSafe sells electronics accessories related to Apple MagSafe technology, including products such as MagSafe-compatible cases, mounts, stands, wallets, charging accessories, power banks, cables, adapters and related accessories.

Product pages may include compatibility information, technical specifications, images, colors, materials and descriptions. We try to keep this information accurate, but minor differences may occur due to manufacturing updates, screen settings, photography, packaging changes or supplier changes.

Compatibility statements are limited to the devices and use cases expressly stated on the relevant product page.

1.3 Apple Trademark and Affiliation Notice

iMegaSafe is an independent store and is not Apple Inc., not owned by Apple Inc., and not affiliated, endorsed, sponsored or authorized by Apple Inc. unless expressly stated in writing for a specific product.

Apple, iPhone, MagSafe, Apple Watch, AirPods and related names, marks, images and logos are trademarks or registered trademarks of Apple Inc. Product names are used only to describe compatibility or intended use.

1.4 Accuracy of Information

We aim to provide accurate product descriptions, prices, availability, shipping estimates and promotional information. We may correct errors, inaccuracies or omissions, including after an order is submitted, where permitted by law.

We reserve the right to update website content at any time. We are not obligated to update every item of information unless required by law.

1.5 Prices, Taxes and Currency

Prices may change without notice before an order is placed. The price charged will generally be the price displayed at checkout, subject to correction of obvious errors and applicable law.

Prices may exclude shipping, customs duties, import taxes, VAT, sales tax, brokerage fees or other charges unless expressly stated at checkout.

Currency conversion shown on the website may be approximate. Your bank, card issuer or payment provider may apply conversion rates or fees.

1.6 Orders, Acceptance and Cancellation

An order is an offer to buy products. We may accept, reject, limit or cancel orders where permitted by law, including if payment fails, information is inaccurate, fraud is suspected, the product is unavailable, shipping is restricted, or an obvious pricing or product error occurred.

After an order is placed, we may not be able to change the shipping address, items or delivery method once processing or fulfillment has started.

If we cancel an order after payment, we will refund the amount paid for the cancelled portion, subject to applicable law.

1.7 Payment

You agree to provide current, complete and accurate billing and payment information. Payments are processed by third-party payment providers. Payment authorization, anti-fraud screening and identity checks may delay or prevent shipment.

We do not control decisions made by banks, card issuers, payment networks or payment providers.

1.8 Shipping, Customs and Import Responsibility

Shipping and delivery are governed by our Shipping Policy. Delivery estimates are estimates, not guaranteed delivery dates unless expressly stated in writing.

Customers are responsible for providing an accurate delivery address and for paying any customs duties, taxes, import charges or local fees unless checkout expressly states otherwise.

You are responsible for confirming that the products may lawfully be imported and used in your destination country.

1.9 Returns, Refunds and Consumer Rights

Returns, refunds, exchanges, statutory withdrawal rights and cancellation rights are governed by our Returns, Refunds & Right of Withdrawal Policy.

Nothing in these Terms limits rights you may have under mandatory consumer protection, product safety, defective goods, warranty, privacy or e-commerce laws.

1.10 Product Use, Safety and Responsibility

You agree to use products only as intended and in accordance with all instructions, warnings and product documentation. You are responsible for ensuring that accessories are suitable for your device, case, charging adapter, environment and intended use.

Do not use damaged cables, chargers, batteries, power banks or accessories. Stop use immediately if a product becomes unusually hot, emits odor, sparks, swells, leaks, cracks, smokes, causes device warnings or appears unsafe.

1.11 User Content, Reviews and Feedback

If you submit reviews, photos, comments, ideas or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt and share that content for store, support, marketing and operational purposes, subject to applicable law.

You are responsible for content you submit and must not submit unlawful, misleading, defamatory, infringing, abusive, obscene, spam or malicious content.

1.12 Prohibited Uses

You must not use the Services for unlawful purposes; infringe intellectual property or privacy rights; transmit malware; attempt unauthorized access; scrape or harvest data without permission; interfere with website security; submit false information; abuse promotions; or resell products in violation of law or our written restrictions.

1.13 Intellectual Property

The website, text, graphics, layout, branding, product descriptions, images, software, design and other content are owned by or licensed to iMegaSafe or its licensors and are protected by intellectual property laws.

You may not copy, modify, distribute, reproduce, sell or exploit website content without written permission, except as allowed by law.

1.14 Third-Party Links and Tools

Our website may contain links, integrations or tools operated by third parties. We are not responsible for third-party websites, policies, content, security, availability or practices. You should review their terms and privacy policies.

1.15 Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted, secure or error-free operation of the website.

Product warranties, if any, are described in the applicable product page, manufacturer documentation or Warranty section below. Mandatory legal warranties and consumer rights remain unaffected.

1.16 Limitation of Liability

To the maximum extent permitted by law, iMegaSafe, its owners, employees, contractors, suppliers and affiliates will not be liable for indirect, incidental, special, consequential or punitive damages, loss of profits, loss of data, business interruption or similar losses arising from the Services or products.

Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability for fraud, intentional misconduct, death or personal injury caused by negligence where such exclusion is not permitted.

1.17 Indemnification

You agree to indemnify and hold harmless iMegaSafe from claims, damages, losses and expenses arising from your misuse of the Services, violation of these Terms, unlawful conduct or infringement of third-party rights, to the extent permitted by law.

1.18 Export Controls, Sanctions and Restricted Destinations

We may refuse, cancel or block orders where required by applicable sanctions, export controls, import restrictions, payment rules, courier restrictions or product safety requirements. We do not knowingly sell or ship products to sanctioned persons, restricted entities or destinations where prohibited by applicable law.

1.19 Governing Law and Disputes

These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law principles. Courts in Israel will have jurisdiction, except where mandatory consumer law gives you the right to bring claims in another jurisdiction or prevents this choice of law or forum from applying.
